This Privacy and Data Protection Statement ("Statement") describes how Indian Gas Exchange Limited ("we," "us," "our," or "the Exchange") collects, uses, processes, stores, and protects your personal data when you access and use the MemberHub platform ("Platform").

We are committed to protecting your privacy and ensuring the security of your personal data in accordance with Digital Personal Data Protection Act, 2023 (DPDP Act), Information Technology Act, 2000 (IT Act), and Other applicable laws and regulations governing data protection in India. As a Data Fiduciary under the DPDP Act, we recognize both your right to protect your personal data and our need to process such data for lawful purposes related to gas exchange trading, clearing, and settlement operations.

2. Definitions

  • For the purposes of this Statement:
  • "Personal Data" means any data about an individual who is identifiable by or in relation to such data, in digital form.
  • "Data Fiduciary" means the Exchange, which determines the purpose and means of processing your personal data.
  • "Data Principal" means you, the individual (Member or authorized user) to whom the personal data relates.
  • "Data Processor" means any person who processes personal data on behalf of the Data Fiduciary.

4. Personal Data We Collect

We collect and process the following categories of personal data:

4.1 Member Registration and KYC Information – Full Name, PAN (Permanent Account Number), GST, TAN and VAT registration details, Registered business and invoice addresses, Contact information including email address and phone numbers, Authorized signatory details with specimen signatures, and your Certificate of Incorporation along with other business registration documents.

4.2 Client Information (for Members registering Clients) – Client name and business details, Client KYC documentation (PAN, GST, VAT, TAN), Certificate of Incorporation, Registered business and invoice addresses, Contact information including email address and phone numbers.

4.3 Financial and Trading Information – Bank account details (account number, IFSC code, bank name, branch).

4.4 Access Information of TradeHub and MemberHub Applications – Login credentials (username, password – stored in encrypted form), IP address and device information, Access logs and timestamps, Session information.

4.5 Communication Records – Correspondence with the Exchange, Email communications, Surveillance Room Call recordings.

5. Purpose and Legal Basis for Processing

We process your personal data for the following lawful purposes:

5.1 With Your Consent – Creating and managing your TradeHub and MemberHub account, Sending promotional communications and updates (where you have opted in) and Processing optional services if you have requested.

5.2 For Legitimate Uses

a) Contractual Necessity – Facilitating trade execution, clearing, and settlement operations, generating trade confirmations, statements and reports and enabling access to platform features and services.

b) Legal and Regulatory Compliance – Complying with PNGRB (Gas Exchange Regulations) 2020 and further amendments, Meeting KYC (Know Your Customer) and AML (Anti-Money Laundering) requirements, fulfilling reporting obligations to regulatory authorities, responding to legal processes, court orders, and government requests and Compliance with tax regulations (including C-Form processing).

c) Security and Fraud Prevention – Detecting, preventing, and investigating fraudulent activities, ensuring platform security and preventing unauthorized access and Monitoring for suspicious trading patterns.

We may share your personal data with the following entities under lawful circumstances:

  • Trade counterparties (buyer/seller information for executed trades)
  • Statutory and regulatory bodies as required by law
  • Banks and financial institutions (for payment processing)
  • Technology service providers
  • Professional advisors (legal, accounting, audit firms)

By accessing and using the MemberHub platform, you acknowledge that:

  2. You provide your free, specific, informed, unconditional, and unambiguous consent to the collection and processing of your personal data as described herein.
